近日，江苏省无锡市曝光一批安全生产培训“走过场”典型案例。这批案例中涉及5起违法行为，共计罚款39.65万元，其中一家公司安全员涉嫌买卖国家机关证件罪以及假冒政府网站制售假冒安全生产证书的犯罪线索被移送公安部门。
应急管理部关于开展安全生产培训“走过场”的通知下发以来，为进一步加强和规范安全生产培训管理，切实提升从业人员安全素质和技能，江苏省无锡市应急管理系统认真开展安全生产培训“走过场”专项整治，查处一批培训制度不落实的生产经营单位，曝光一批违法违规典型案例，进一步规范安全生产培训秩序，提升培训质量，确保“走过场”专项整治取得实效。
截至目前，该市共发现安全生产培训“走过场”问题500余条，教育培训类立案119件，处罚金额共计490余万元。（本报记者）
案例一
基本案情：2021年11月30日，无锡市新吴区应急管理局执法人员对无锡市新国铸造设备有限公司进行执法检查，发现该公司提供的两名员工的特种作业操作证无法在应急管理部官网查询到相关信息，经深入调查发现上述特种作业操作证链接的网站为假冒政府网站。
该公司存在特种作业人员未按照规定经专门的安全作业培训并取得相应资格上岗作业，使用伪造的特种作业操作证的行为，同时该公司安全员朱某涉嫌买卖国家机关证件。
处罚依据：该公司的行为违反了安全生产法第三十条第一款和《特种作业人员安全技术培训考核管理规定》第三十六条第一款的规定。
无锡市新吴区应急管理局根据安全生产法第九十七条第（七）项和《特种作业人员安全技术培训考核管理规定》第四十条的规定并结合自由裁量，对该公司作出罚款人民币10.9万元的行政处罚，同时按照《安全生产行政执法与刑事司法衔接工作办法》的规定，将该公司安全员朱某涉嫌买卖国家机关证件罪以及假冒政府网站制售假冒安全生产证书的犯罪线索移送公安部门。
案例二
基本案情：2022年2月17日，江阴市长泾镇根据人社部门推送的工伤申报单位信息，研判分析后组织对江阴市鑫达药化机械制造有限公司开展安全生产培训“走过场”检查，发现该单位一线操作工潘某违反车床安全操作规程造成一根手指被砸伤，经调查，该单位存在未如实记录潘某安全教育培训情况的问题。
处罚依据：上述行为违反了安全生产法第二十八条第四款的规定，江阴市长泾镇人民政府根据安全生产法第九十七条第（四）项的规定并结合自由裁量，对该单位作出罚款人民币1.8万元的行政处罚。
案例三
基本案情：2021年11月4日，无锡市应急管理局执法人员对无锡市志成生化工程装备有限公司进行举报核查时，发现该公司未如实记录安全生产教育和培训情况；特种作业人员未按照规定经专门的安全作业培训并取得相应资格，上岗作业；未将安全风险管控纳入年度安全生产教育培训计划且未组织实施。
处罚依据：该公司违反了安全生产法第二十八条第四款、第三十条第一款和《江苏省工业企业安全生产风险报告规定》第十七条的规定。无锡市应急管理局依据安全生产法第九十七条第（四）项、第（七）项和《江苏省工业企业安全生产风险报告规定》第三十四条第（四）项的规定并结合自由裁量，对该公司作出罚款人民币9.575万元的行政处罚。
案例四
基本案情：2022年2月23日，江阴市月城镇执法人员对无锡上江净化设备有限公司进行执法检查时，发现该单位存在未按照规定对从业人员进行安全生产教育和培训，未建立工业企业安全风险辨识管控制度的问题。
处罚依据：上述行为违反了安全生产法第二十八条第一款和《江苏省工业企业安全生产风险报告规定》第七条的规定，江阴市月城镇人民政府依据安全生产法第九十七条第（三）项和《江苏省工业企业安全生产风险报告规定》第三十四条第（一）项的规定并结合自由裁量，对该单位作出罚款人民币10.375万元的行政处罚。
案例五
基本案情：2021年12月6日，江阴市长泾镇执法人员对无锡鹿元服装科技有限公司进行检查时，发现该单位存在未如实记录缝纫车间16名新入职员工的安全教育培训情况。
处罚依据：上述行为违法了安全生产法第二十八条第四款的规定，江阴市长泾镇人民政府依据安全生产法第九十七条第（四）项的规定并结合自由裁量，对该单位作出罚款人民币7万元的行政处罚。

Case one
The basic case: On November 30, 2021, the law enforcement officers of Wuxi Xinwu District Emergency Management Bureau conducted an enforcement inspection of Wuxi Xinguo Casting Equipment Co.
The company has special operators not in accordance with the provisions of the special safety training and obtain the appropriate qualifications to work, the use of forged special operations certificate behavior, while the company's safety officer Zhu suspected of trading state organs documents.
Penalty basis: The company's behavior violated the provisions of Article 30, paragraph 1 of the Work Safety Law and Article 36, paragraph 1 of the Regulations on the Management of Safety Technical Training and Examination for Special Operators.
According to the provisions of Article 97(7) of the Work Safety Law and Article 40 of the Regulations on the Administration of Safety Technical Training and Examination for Special Operators, the Emergency Management Bureau of Wuxi Xinwu District imposed an administrative penalty of RMB109,000 on the company, and at the same time, in accordance with the provisions of the Measures for the Interface between Administrative Law Enforcement and Criminal Justice in Work Safety, Zhu, a safety officer of the company, was suspected of trading At the same time, in accordance with the "Measures for the Interface between Administrative Law Enforcement and Criminal Justice", the company's safety officer Zhu was transferred to the public security department for the crime of buying and selling documents of state organs and the crime of counterfeiting government websites to sell counterfeit production safety certificates.
Case 2
Basic case: On February 17, 2022, Jiangyin Changjing Town, according to the information of work injury declaration units pushed by the human resources department, after research and analysis, organized a "walk-through" inspection of the safety production training of Jiangyin Xinda Pharmacy Machinery Manufacturing Co. Finger was smashed, after investigation, the unit there is no truthful record of the safety education and training of Pan.
Penalty basis: The above-mentioned behavior violates the provisions of Article 28 (4) of the Work Safety Law, and the People's Government of Jiangyin Changjing Town, in accordance with the provisions of Article 97 (4) of the Work Safety Law and combined with discretion, imposed an administrative penalty of RMB 18,000 yuan on the unit.
Case 3
Basic case: On November 4, 2021, the law enforcement officers of Wuxi Emergency Management Bureau conducted a report verification of Wuxi Zhicheng Biochemical Engineering Equipment Co., Ltd. and found that the company did not truthfully record the production safety education and training; the special operators were not trained and qualified for special safety operations in accordance with the regulations and were on duty; the safety risk control was not included in the annual production safety education and training plan and did not organize the implementation.
Penalty basis: The company violated the fourth paragraph of Article 28 and the first paragraph of Article 30 of the Work Safety Law and the provisions of Article 17 of the "Jiangsu Province Industrial Enterprises Safety Production Risk Reporting Regulations". Based on the provisions of Article 97(4) and (7) of the Production Safety Law and Article 34(4) of the Jiangsu Province Industrial Enterprises Safety Production Risk Reporting Regulations and combined with the discretion, the Wuxi Emergency Management Bureau imposed an administrative penalty of RMB 95.75 million on the company.
Case 4
Basic facts: On February 23, 2022, law enforcement officers of Yue Town, Jiangyin City, conducted an enforcement inspection of Wuxi Shangjiang Purification Equipment Co., Ltd. and found that the unit had failed to provide safety education and training for employees in accordance with the regulations and had not established a safety risk identification and control system for industrial enterprises.
Penalty basis: The above-mentioned behavior violates the first paragraph of Article 28 of the Work Safety Law and the provisions of Article 7 of the "Jiangsu Province Industrial Enterprises Safety Production Risk Report". The administrative penalty is RMB103,750,000.
Case 5
Basic facts: On December 6, 2021, the law enforcement officers of Jiangyin Changjing Town inspected Wuxi Luyuan Garment Technology Co., Ltd. and found that the unit failed to record the safety education and training of 16 new employees in the sewing workshop.
Penalty basis: The above-mentioned behavior violates the provisions of Article 28 (4) of the Work Safety Law, and the People's Government of Jiangyin Changjing Township, in accordance with the provisions of Article 97 (4) of the Work Safety Law and combined with discretion, imposed an administrative penalty of RMB 70,000 on the unit.
