第一章  总则

第一条  为规范社会消防技术服务活动,维护消防技术服务市场秩序,促进提高消防技术服务质量,根据《中华人民共和国消防法》,制定本规定。

第二条  在中华人民共和国境内从事社会消防技术服务活动、对消防技术服务机构实施监督管理,适用本规定。

本规定所称消防技术服务机构是指从事消防设施维护保养检测、消防安全评估等社会消防技术服务活动的企业。

第三条  消防技术服务机构及其从业人员开展社会消防技术服务活动应当遵循客观独立、合法公正、诚实信用的原则。

本规定所称消防技术服务从业人员,是指依法取得注册消防工程师资格并在消防技术服务机构中执业的专业技术人员,以及按照有关规定取得相应消防行业特有工种职业资格,在消防技术服务机构中从事社会消防技术服务活动的人员。

第四条  消防技术服务行业组织应当加强行业自律管理,规范从业行为,促进提升服务质量。

消防技术服务行业组织不得从事营利性社会消防技术服务活动,不得从事或者通过消防技术服务机构进行行业垄断。

第二章  从业条件

第五条  从事消防设施维护保养检测的消防技术服务机构,应当具备下列条件:

(一)取得企业法人资格;

(二)工作场所建筑面积不少于200平方米;

(三)消防技术服务基础设备和消防设施维护保养检测设备配备符合有关规定要求;

(四)注册消防工程师不少于2人,其中一级注册消防工程师不少于1人;

(五)取得消防设施操作员国家职业资格证书的人员不少于6人,其中中级技能等级以上的不少于2人;

(六)健全的质量管理体系。

第六条  从事消防安全评估的消防技术服务机构,应当具备下列条件:

(一)取得企业法人资格;

(二)工作场所建筑面积不少于100平方米;

(三)消防技术服务基础设备和消防安全评估设备配备符合有关规定要求;

(四)注册消防工程师不少于2人,其中一级注册消防工程师不少于1人;

(五)健全的消防安全评估过程控制体系。

第七条  同时从事消防设施维护保养检测、消防安全评估的消防技术服务机构,应当具备下列条件:

(一)取得企业法人资格;

(二)工作场所建筑面积不少于200平方米;

(三)消防技术服务基础设备和消防设施维护保养检测、消防安全评估设备配备符合规定的要求;

(四)注册消防工程师不少于2人,其中一级注册消防工程师不少于1人;

(五)取得消防设施操作员国家职业资格证书的人员不少于6人,其中中级技能等级以上的不少于2人;

(六)健全的质量管理和消防安全评估过程控制体系。

第八条  消防技术服务机构可以在全国范围内从业。

第三章  社会消防技术服务活动

第九条  消防技术服务机构及其从业人员应当依照法律法规、技术标准和从业准则,开展下列社会消防技术服务活动,并对服务质量负责:

(一)消防设施维护保养检测机构可以从事建筑消防设施维护保养、检测活动;

(二)消防安全评估机构可以从事区域消防安全评估、社会单位消防安全评估、大型活动消防安全评估等活动,以及消防法律法规、消防技术标准、火灾隐患整改、消防安全管理、消防宣传教育等方面的咨询活动。

消防技术服务机构出具的结论文件,可以作为消防救援机构实施消防监督管理和单位(场所)开展消防安全管理的依据。

第十条  消防设施维护保养检测机构应当按照国家标准、行业标准规定的工艺、流程开展维护保养检测,保证经维护保养的建筑消防设施符合国家标准、行业标准。

第十一条  消防技术服务机构应当依法与从业人员签订劳动合同,加强对所属从业人员的管理。注册消防工程师不得同时在两个以上社会组织执业。

第十二条  消防技术服务机构应当设立技术负责人,对本机构的消防技术服务实施质量监督管理,对出具的书面结论文件进行技术审核。技术负责人应当具备一级注册消防工程师资格。

第十三条  消防技术服务机构承接业务,应当与委托人签订消防技术服务合同,并明确项目负责人。项目负责人应当具备相应的注册消防工程师资格。

消防技术服务机构不得转包、分包消防技术服务项目。

第十四条  消防技术服务机构出具的书面结论文件应当由技术负责人、项目负责人签名并加盖执业印章,同时加盖消防技术服务机构印章。

消防设施维护保养检测机构对建筑消防设施进行维护保养后,应当制作包含消防技术服务机构名称及项目负责人、维护保养日期等信息的标识,在消防设施所在建筑的醒目位置上予以公示。

第十五条  消防技术服务机构应当对服务情况作出客观、真实、完整的记录,按消防技术服务项目建立消防技术服务档案。

消防技术服务档案保管期限为6年。

第十六条  消防技术服务机构应当在其经营场所的醒目位置公示营业执照、工作程序、收费标准、从业守则、注册消防工程师注册证书、投诉电话等事项。

第十七条  消防技术服务机构收费应当遵守价格管理法律法规的规定。

第十八条  消防技术服务机构在从事社会消防技术服务活动中,不得有下列行为:

(一)不具备从业条件,从事社会消防技术服务活动;

(二)出具虚假、失实文件;

(三)消防设施维护保养检测机构的项目负责人或者消防设施操作员未到现场实地开展工作;

(四)泄露委托人商业秘密;

(五)指派无相应资格从业人员从事社会消防技术服务活动;

(六)冒用其他消防技术服务机构名义从事社会消防技术服务活动;

(七)法律、法规、规章禁止的其他行为。

第四章  监督管理

第十九条  县级以上人民政府消防救援机构依照有关法律、法规和本规定,对本行政区域内的社会消防技术服务活动实施监督管理。

消防技术服务机构及其从业人员对消防救援机构依法进行的监督管理应当协助和配合,不得拒绝或者阻挠。

第二十条  应急管理部消防救援局应当建立和完善全国统一的社会消防技术服务信息系统,公布消防技术服务机构及其从业人员的有关信息,发布从业、诚信和监督管理信息,并为社会提供有关信息查询服务。

第二十一条  县级以上人民政府消防救援机构对社会消防技术服务活动开展监督检查的形式有:

(一)结合日常消防监督检查工作,对消防技术服务质量实施监督抽查;

(二)根据需要实施专项检查;

(三)发生火灾事故后实施倒查;

(四)对举报投诉和交办移送的消防技术服务机构及其从业人员的违法从业行为进行核查。

开展社会消防技术服务活动监督检查可以根据实际需要,通过网上核查、服务单位实地核查、机构办公场所现场检查等方式实施。

第二十二条  消防救援机构在对单位(场所)实施日常消防监督检查时,可以对为该单位(场所)提供服务的消防技术服务机构的服务质量实施监督抽查。抽查内容为:

(一)是否冒用其他消防技术服务机构名义从事社会消防技术服务活动;

(二)从事相关社会消防技术服务活动的人员是否具有相应资格;

(三)是否按照国家标准、行业标准维护保养、检测建筑消防设施,经维护保养的建筑消防设施是否符合国家标准、行业标准;

(四)消防设施维护保养检测机构的项目负责人或者消防设施操作员是否到现场实地开展工作;

(五)是否出具虚假、失实文件;

(六)出具的书面结论文件是否由技术负责人、项目负责人签名、盖章,并加盖消防技术服务机构印章;

(七)是否与委托人签订消防技术服务合同;

(八)是否在经其维护保养的消防设施所在建筑的醒目位置公示消防技术服务信息。

第二十三条  消防救援机构根据消防监督管理需要,可以对辖区内从业的消防技术服务机构进行专项检查。专项检查应当随机抽取检查对象,随机选派检查人员,检查情况及查处结果及时向社会公开。专项检查可以抽查下列内容:

(一)是否具备从业条件;

(二)所属注册消防工程师是否同时在两个以上社会组织执业;

(三)从事相关社会消防技术服务活动的人员是否具有相应资格;

(四)是否转包、分包消防技术服务项目;

(五)是否出具虚假、失实文件;

(六)是否设立技术负责人、明确项目负责人,出具的书面结论文件是否由技术负责人、项目负责人签名、盖章,并加盖消防技术服务机构印章;

(七)是否与委托人签订消防技术服务合同;

(八)是否在经营场所公示营业执照、工作程序、收费标准、从业守则、注册消防工程师注册证书、投诉电话等事项;

(九)是否建立和保管消防技术服务档案。

第二十四条  发生有人员死亡或者造成重大社会影响的火灾,消防救援机构开展火灾事故调查时,应当对为起火单位(场所)提供服务的消防技术服务机构实施倒查。

消防救援机构组织调查其他火灾,可以根据需要对为起火单位(场所)提供服务的消防技术服务机构实施倒查。

倒查按照本规定第二十二条、第二十三条的抽查内容实施。

第二十五条  消防救援机构及其工作人员不得设立消防技术服务机构,不得参与消防技术服务机构的经营活动,不得指定或者变相指定消防技术服务机构,不得利用职务接受有关单位或者个人财物,不得滥用行政权力排除、限制竞争。

第五章  法律责任

第二十六条  消防技术服务机构违反本规定,冒用其他消防技术服务机构名义从事社会消防技术服务活动的,责令改正,处2万元以上3万元以下罚款。

第二十七条  消防技术服务机构违反本规定,有下列情形之一的,责令改正,处1万元以上2万元以下罚款:

(一)所属注册消防工程师同时在两个以上社会组织执业的;

(二)指派无相应资格从业人员从事社会消防技术服务活动的;

(三)转包、分包消防技术服务项目的。

对有前款第一项行为的注册消防工程师,处5000元以上1万元以下罚款。

第二十八条  消防技术服务机构违反本规定,有下列情形之一的,责令改正,处1万元以下罚款:

(一)未设立技术负责人、未明确项目负责人的;

(二)出具的书面结论文件未经技术负责人、项目负责人签名、盖章,或者未加盖消防技术服务机构印章的;

(三)承接业务未依法与委托人签订消防技术服务合同的;

(四)消防设施维护保养检测机构的项目负责人或者消防设施操作员未到现场实地开展工作的;

(五)未建立或者保管消防技术服务档案的;

(六)未公示营业执照、工作程序、收费标准、从业守则、注册消防工程师注册证书、投诉电话等事项的。

第二十九条  消防技术服务机构不具备从业条件从事社会消防技术服务活动或者出具虚假文件、失实文件的,或者不按照国家标准、行业标准开展社会消防技术服务活动的,由消防救援机构依照《中华人民共和国消防法》第六十九条的有关规定处罚。

第三十条  消防设施维护保养检测机构未按照本规定要求在经其维护保养的消防设施所在建筑的醒目位置上公示消防技术服务信息的,责令改正,处5000元以下罚款。

第三十一条  消防救援机构对消防技术服务机构及其从业人员实施积分信用管理,具体办法由应急管理部消防救援局制定。

第三十二条  消防技术服务机构有违反本规定的行为,给他人造成损失的,依法承担赔偿责任;经维护保养的建筑消防设施不能正常运行,发生火灾时未发挥应有作用,导致伤亡、损失扩大的,从重处罚;构成犯罪的,依法追究刑事责任。

第三十三条  本规定中的行政处罚由违法行为地设区的市级、县级人民政府消防救援机构决定。

第三十四条  消防技术服务机构及其从业人员对消防救援机构在消防技术服务监督管理中作出的具体行政行为不服的,可以依法申请行政复议或者提起行政诉讼。

第三十五条  消防救援机构的工作人员设立消防技术服务机构,或者参与消防技术服务机构的经营活动,或者指定、变相指定消防技术服务机构,或者利用职务接受有关单位、个人财物,或者滥用行政权力排除、限制竞争,或者有其他滥用职权、玩忽职守、徇私舞弊的行为,依照有关规定给予处分;构成犯罪的,依法追究刑事责任。

第六章  附则

第三十六条  保修期内的建筑消防设施由施工单位进行维护保养的,不适用本规定。

第三十七条  本规定所称虚假文件,是指消防技术服务机构未提供服务或者以篡改结果方式出具的消防技术文件,或者出具的与当时实际情况严重不符、结论定性严重偏离客观实际的消防技术文件。

本规定所称失实文件,是指消防技术服务机构出具的与当时实际情况部分不符、结论定性部分偏离客观实际的消防技术文件。

第三十八条  本规定中的“以上”、“以下”均含本数。

第三十九条  执行本规定所需要的文书式样,以及消防技术服务机构应当配备的仪器、设备、设施目录,由应急管理部制定。

第四十条  本规定自2021年11月9日起施行。

Chapter I General Provisions

Article fire technical service agencies and their practitioners to carry out social fire technology service activities should follow the principles of objectivity and independence, lawfulness and fairness, honesty and credit.

Fire technical services practitioners referred to in this provision, refers to the qualification of registered fire engineers and fire technical services in the practice of professional and technical personnel, as well as in accordance with the relevant provisions of the corresponding fire industry-specific occupational qualifications, in the fire technical services agencies engaged in social fire technical services activities.

Article IV of the fire protection technical service industry organizations should strengthen industry self-regulation management, regulate the practice of behavior, and promote the quality of service.

Fire technical service industry organizations shall not engage in profit-making social fire protection technical service activities, shall not engage in or through the fire technical service organizations to carry out industry monopoly.

Chapter II conditions of practice

Article V engaged in fire service facilities maintenance and inspection of fire protection technical service agencies, should have the following conditions.

(A) to obtain legal personality of enterprises.

(B) workplace construction area of not less than 200 square meters.

(C) fire protection technical services infrastructure equipment and fire facility maintenance and testing equipment to meet the requirements of the relevant provisions; (D) registered fire engineers not less than 200 square meters.

(D) not less than two registered fire engineers, of which not less than one is a registered fire engineer.

(E) obtain the national vocational qualification certificate for fire protection facilities operator not less than 6 people, including intermediate skills level of not less than 2 people.

(F) a sound quality management system.

Article VI engaged in fire safety assessment of fire protection technical service agencies, should have the following conditions.

(A) to obtain legal personality of enterprises.

(B) workplace construction area of not less than 100 square meters.

(C) fire technology services infrastructure and fire safety assessment equipment to meet the requirements of the relevant provisions; (D) registered fire engineers not less than 100 square meters.

(D) not less than two registered fire engineers, of which not less than one is a registered fire engineer.

(E) a sound fire safety assessment process control system.

Article VII is also engaged in fire facility maintenance and inspection, fire safety assessment of the fire protection technical service agencies, should have the following conditions.

(A) to obtain enterprise legal person qualification.

(B) workplace floor space of not less than 200 square meters.

(C) fire technology services infrastructure equipment and fire facility maintenance testing, fire safety assessment equipment to meet the prescribed requirements.

(D) registered fire engineers not less than two people, including not less than one first-class registered fire engineers.

(E) obtain the national vocational qualification certificate for fire protection facility operators not less than 6 people, of which not less than 2 people above the intermediate skill level.

(F) sound quality management and fire safety assessment process control system.

Article VIII of the fire protection technical service agencies can practice nationwide.

Chapter III social fire technology service activities

Article IX of the fire protection technical service agencies and their practitioners shall, in accordance with laws and regulations, technical standards and practice guidelines, the following social fire technology service activities, and is responsible for the quality of service.

(A) fire facility maintenance and testing agencies can engage in building fire facility maintenance, testing activities.

(B) fire safety assessment agencies can be engaged in regional fire safety assessment, fire safety assessment of social units, large-scale activities such as fire safety assessment activities, as well as fire laws and regulations, fire technology standards, fire hazard rectification, fire safety management, fire prevention and education and other aspects of consulting activities.

Fire technical services issued by the conclusion of the document, can be used as a fire rescue agencies to implement fire supervision and management and units (places) to carry out fire safety management basis.

Article X of the fire service facilities maintenance and testing agencies should be in accordance with national standards, industry standards, processes, maintenance testing to ensure that the maintenance of building fire facilities in line with national standards, industry standards.

Article XI of the fire protection technical service agencies shall sign labor contracts with practitioners in accordance with the law, and strengthen the management of their practitioners. Registered fire engineers shall not practice in more than two social organizations at the same time.

Article XII of the fire protection technical service agencies shall establish a technical person in charge of the agency's fire protection technical services to implement quality supervision and management, the written conclusions issued by the technical review of documents. Technical person in charge should have a registered fire engineer qualification.

Article XIII of the fire protection technical service agencies to undertake business, shall sign a fire protection technical service contract with the client, and a clear project leader. Project leader should have the corresponding qualifications of registered fire engineers.

Fire protection technical service agencies shall not subcontract, subcontracting fire protection technical service projects.

Article XIV of the written conclusions issued by the fire protection technical service agency documents should be signed by the technical person in charge, the person in charge of the project and stamped with the seal of practice, while the seal of the fire protection technical service agency.

Fire facility maintenance and inspection agencies to maintain the building fire facilities, should be made to include the name of the fire service agency and the project leader, maintenance date and other information on the logo, the fire facilities in the building in a prominent position on the public.

Article XV of the fire protection technical service agencies shall make objective, true and complete records of the service, according to the fire technology service projects to establish fire technology service files.

Fire protection technical service file storage period of six years.

Article XVI of the fire protection technical service agencies should be in its place of business in a prominent position to publicize business licenses, work procedures, fees, codes of practice, registered fire engineers registration certificate, complaint phone and other matters.

Article XVII of the fire protection technical service providers shall comply with the provisions of laws and regulations on price management.

Article XVIII of the fire protection technical service agencies engaged in social fire technology service activities, shall not have the following behavior.

(A) does not have the conditions of practice, engaged in social fire technology service activities.

(B) the issuance of false, inaccurate documents.

(C) the project leader of the fire facility maintenance and inspection agency or fire facility operator is not on site to carry out field work.

(D) leakage of commercial secrets of the client.

(E) the assignment of practitioners without the appropriate qualifications to engage in social fire technology service activities.

(F) fraudulent use of the name of other fire protection technical service agencies engaged in social fire technology services.

(G) the laws, regulations and rules prohibit other acts.

Chapter IV Supervision and management

Article 19 of the people's government at or above the county level fire rescue agencies in accordance with relevant laws, regulations and the provisions of this, the administrative region of the social fire technical service activities to implement supervision and management.

Fire technical service agencies and their practitioners of fire rescue agencies in accordance with the supervision and management shall assist and cooperate, and shall not refuse or obstruct.

Article 20 The Ministry of Emergency Management Fire Rescue Bureau shall establish and improve the national unified social fire technical services information system, the announcement of fire technical service agencies and their practitioners, the release of information on the practice, integrity and supervision and management, and to provide the community with information query services.

Article 21 The fire rescue agencies of the people's governments at or above the county level to carry out supervision and inspection of social fire protection technical service activities in the form of.

(A) combined with routine fire fighting supervision and inspection work, the quality of fire protection technical services to implement supervision and random inspections.

(B) the implementation of special inspections as needed

(C) the implementation of backtracking after a fire accident.

(D) to report complaints and referrals of fire protection technical service agencies and their practitioners to verify the illegal practice.

Article 22 of the fire rescue agencies in the implementation of daily fire fighting supervision and inspection of units (premises), you can provide services for the unit (premises) of the fire technical service agencies to implement the quality of service supervision spot checks. Spot checks are.

(A) whether to engage in social fire technical service activities under the name of other fire protection technical service agencies.

(B) whether the personnel engaged in the relevant social fire technology service activities have the appropriate qualifications.

(C) whether in accordance with national standards, industry standards for maintenance, testing of building fire facilities, maintenance of building fire facilities are in line with national standards, industry standards.

(D) whether the project leader of the fire facility maintenance and testing agency or fire facility operator to the field to carry out the work.

(E) whether to issue false, inaccurate documents.

(F) whether the written conclusions issued by the technical person in charge, the person in charge of the project signed, sealed, and stamped with the seal of the fire protection technical service agency.

(vii) whether to sign a fire protection technical service contract with the principal

(H) whether the maintenance of fire protection facilities in the building by its conspicuous location of the prominently displayed fire protection technical services information.

Article 23 The fire rescue agencies according to fire supervision and management needs, can be a special inspection of the fire technical service agencies engaged in the area. (A) whether the conditions of practice.

(C) whether the personnel engaged in the relevant social fire technology service activities have the appropriate qualifications.

(D) whether subcontracting, subcontracting fire technology service projects.

(E) whether to issue false, inaccurate documents.

(F) whether the establishment of the technical person in charge, a clear project leader, whether the written conclusions issued by the technical person in charge, the project leader signed, sealed, and stamped with the seal of the fire protection technical service agency.

(vii) whether to sign a contract with the client fire technology services.

(H) whether the business license, work procedures, fees, codes of practice, registered fire engineers registration certificate, complaint telephone and other matters are publicly displayed in the business premises.

(ix) whether to establish and maintain the technical fire service files.

Article 24 of the occurrence of fires with fatalities or cause significant social impact, fire rescue agencies to carry out fire accident investigation, should provide services for the fire unit (premises) fire technical service agencies to implement the reverse check.

Fire rescue agencies to organize investigations of other fires, as needed for the fire unit (premises) to provide services for the implementation of fire technical service agencies to reverse the investigation.

Article 25 of the fire rescue agencies and their staff shall not set up fire technical service agencies, shall not participate in the operation of fire technical service agencies, shall not designate or disguise the designation of fire technical service agencies, shall not use their positions to accept the relevant units or personal belongings, shall not abuse administrative power to exclude or restrict competition.

Chapter V Legal Liability

Article 26 The fire protection technical service agencies in violation of these provisions, fraudulently using the name of other fire protection technical service agencies engaged in social fire protection technical service activities, shall order rectification and impose a fine of 20,000 yuan or more than 30,000 yuan.

Article 27 The fire protection technical service agencies in violation of these provisions, one of the following circumstances, shall order rectification and impose a fine of 10,000 yuan or more than 20,000 yuan.

(A) belonging to the registered fire engineers practicing in more than two social organizations at the same time

(B) the assignment of practitioners without the appropriate qualifications to engage in social fire technology service activities

(C) subcontracting, subcontracting of fire protection technical services projects.

(E) the failure to establish or maintain the fire protection technical service files

(F) did not publicize the business license, work procedures, fees, codes of practice, registered fire engineers registration certificate, complaint telephone and other matters.

Article 29 The fire protection technical service agencies do not have the conditions to engage in social fire technology service activities or issue false documents, inaccurate documents, or not in accordance with national standards, industry standards to carry out social fire technology service activities, the fire rescue agencies in accordance with the "Fire Law of the People's Republic of China" Article 69 of the relevant provisions of the penalty.

Article 30 The fire service facilities maintenance and inspection agencies are not in accordance with the requirements of this provision in accordance with its maintenance of the fire service facilities located on the prominent position of the building public fire technical service information, ordered to correct, a fine of 5,000 yuan.

Article 31 The fire rescue agencies on the technical fire service agencies and their practitioners to implement credit management points, the specific measures developed by the Ministry of Emergency Management Fire Rescue Bureau.

Article 32 The fire protection technical service agencies have violated the provisions of the act, causing damage to others, shall bear the responsibility to compensate; by the maintenance of building fire facilities can not function properly, the fire did not play its proper role, resulting in casualties, the expansion of losses, the heavier the penalty; constitutes a crime, shall be held criminally responsible.

Article 33 The administrative penalties provided for in these provisions by the municipalities where the violations, county-level people's government fire rescue agencies to decide.

Article 34 The technical fire service agencies and their practitioners of fire rescue agencies in the supervision and management of fire fighting technical services to make specific administrative acts, you may apply for administrative reconsideration or bring an administrative lawsuit.
