为推进国家安全发展示范城市创建,规范创建过程中的评价与管理工作,依据《中共中央国务院关于推进安全生产领域改革发展的意见》和中共中央办公厅、国务院办公厅《关于推进城市安全发展的意见》规定要求,国务院安委会研究制定了《国家安全发展示范城市评价与管理办法》。经国务院安委会全体会议审议通过,现予印发,请认真贯彻落实。

国家安全发展示范城市评价与管理办法

第一章 总则

第一条为推进国家安全发展示范城市创建,规范创建过程中的评价与管理工作,依据《中共中央国务院关于推进安全生产领域改革发展的意见》和中共中央办公厅、国务院办公厅《关于推进城市安全发展的意见》规定要求,制定本办法。

第二条各地区要积极参与国家安全发展示范城市创建,坚持城市主动申请、逐级复核评议、部门共同参与、命名动态管理的原则,在全国范围内树立一批基础条件好、保障能力强的安全发展城市代表,充分发挥示范引领作用,全面提高城市安全保障水平。

第三条国家安全发展示范城市评价与管理工作由国务院安全生产委员会(以下简称国务院安委会)统一部署,国务院安全生产委员会办公室(以下简称国务院安委办)组织实施。

第四条国家安全发展示范城市每年评价命名一次,经城市自评、省级复核、国家评议后,由国务院安委会统一命名授牌。获得命名的国家安全发展示范城市三年后复评,符合条件的继续保留命名,未通过复评的由国务院安委会撤销命名并摘牌。

第五条国务院安委办负责制定《国家安全发展示范城市评价细则》(以下简称《评价细则》),并根据实际情况及时修订完善。

第六条本办法适用于由国务院安委会命名授牌的国家安全发展示范城市评价与管理工作。

第二章 基本条件

第七条国家安全发展示范城市创建的范围为副省级城市、地级行政区以及直辖市所辖行政区(县)。

第八条参加国家安全发展示范城市创建的城市(以下简称参评城市)要聚焦以安全生产为基础的城市安全发展体系建设,积极推动完善城市安全各项工作,主要包括以下5个方面:

(一)源头治理。把城市安全纳入经济社会发展总体规划,加强建设项目安全评估论证,推动市政安全设施、城市地下综合管廊、道路交通安全设施、城市防洪安全设施等城市基础及安全设施建设,推进实施城区高危行业企业搬迁改造和转型升级等。

(二)风险防控。重点防范危险化学品企业、油气长输管道、尾矿库、渣土场以及施工作业等城市工业企业风险,大型群众性活动、“九小”场所、高层建筑等人员密集场所风险,城市生命线、公共交通、隧道桥梁等公共设施风险,洪涝、地震、地质等自然灾害风险。

(三)监督管理。健全城市各级党委政府“党政同责、一岗双责、齐抓共管、失职追责”的安全领导责任和相关部门“管行业必须管安全、管业务必须管安全、管生产经营必须管安全”的安全监管责任,积极开展城市风险辨识、评估与监控工作,不断加强城市安全监管执法。

(四)保障能力。强化安全科技创新应用,制定政府购买安全服务指导目录,加大城市安全领域失信惩戒力度,建立城市社区网格化安全管理工作制度,加大公益广告投放、安全体验基地建设力度,培育城市安全文化氛围。

(五)应急救援。建立城市应急管理信息平台,健全应急预案体系以及应急信息报告制度、统一指挥和多部门协同响应机制、应急物资储备调用机制,加大城市应急避难场所覆盖面,强化国家综合性消防救援队伍建设,完善专兼职和志愿应急救援体系,建立城市专业化应急救援基地和队伍,鼓励企业、社会力量参与救援。

第九条存在以下情形的,不得参与创建国家安全发展示范城市:

(一)在参评年及前5个自然年内发生特别重大事故灾难,或在参评年及前3个自然年内发生重大事故灾难的;

(二)在参评年及前1个自然年,因城市安全有关工作不力,被国务院安委会及安委办约谈、通报的;

(三)国务院安委会及安委办挂牌督办的重大安全隐患未按时整改到位的;

(四)已获得命名城市被国务院安委会撤销命名未满2年的;

(五)在参评年及前1个自然年内,发生重特大环境污染和生态破坏事件、药品安全事件和食品安全事故,或者因工作不力导致重特大自然灾害事件损失扩大、造成恶劣影响的;

(六)存在其他情形,不宜参加国家安全发展示范城市创建的。

参评城市在国务院安委会正式命名授牌前发生前述第一项、第二项、第三项、第五项、第六项情形之一的,取消其命名授牌。

第三章 城市自评

第十条参评城市要建立健全国家安全发展示范城市创建工作的组织领导机制,推动相关部门各司其职、各负其责,强化人力、物力、财力等各项保障措施,协调解决创建工作中的重大问题。

第十一条参评城市要按照《评价细则》要求,委托专家学者、科研单位、社会团体或中介组织等重点对城市建成区安全状况开展第三方评价。参与评价的第三方人员应具有能够涵盖城市安全相关业务的专业知识,无违法、失信等不良信用记录,并依法对相关评价结果负责。

第十二条评价结果符合国家安全发展示范城市标准要求的,参评城市可以城市人民政府名义向省级安全生产委员会(以下简称省级安委会)提出参加国家安全发展示范城市创建的申请,并提交以下材料:

(一)城市创建工作情况;

(二)城市自评打分情况;

(三)自评过程中发现本地区城市安全有关问题的整改情况或整改计划;

(四)其他需要向省级安委会提交的材料。

第四章 省级复核

第十三条省级安委办组织对参评城市提交的材料进行初审,需要补充材料的,及时反馈参评城市补报;不符合参评要求的,终止当年评价。

第十四条省级安委办应组织有关成员单位人员和专家对通过初审的城市开展复核工作,具体对参评城市提交的材料进行审核把关,并对《评价细则》中的项目进行现场复核,综合提出复核意见。

第十五条省级安委办应征求省级安委会相关成员单位的意见建议,结合日常监督检查情况,综合提出拟向国务院安委办推荐的城市名单,在省级层面相关政府网站和主流媒体上进行为期10个工作日的社会公示,并公开诉求渠道。

省级安委会应结合公示受理情况,于参评年7月底前正式向国务院安委办推荐参评城市,并提交以下材料:

(一)参评城市人民政府向省级安委会提交的参与国家安全发展示范城市创建的相关材料;

(二)省级复核情况;

(三)省级公示情况;

(四)省级复核及公示过程中发现城市安全有关问题的整改情况或整改计划;

(五)省级安委会的推荐意见;

(六)其他需要向国务院安委办提交的材料。

第五章 国家评议

第十六条国务院安委办对各省级安委会推荐的参评城市相关材料进行初审,对于不符合参评要求的,退回省级安委会并取消当年参评资格;需要补充材料的,及时反馈省级安委会补报。

第十七条国务院安委办组织由国务院安委会有关成员单位人员和专家等组成的综合评议委员会,具体负责对通过初审的参评城市开展综合评议工作。

综合评议委员会主要对城市自评和省级复核的程序、材料等进行评议,并组织人员赴参评城市现场抽查核实主要评价指标完成情况,提出综合评议意见。

第十八条国务院安委办应征求国务院安委会相关成员单位的意见建议,结合日常监督检查情况,综合提出拟公示的国家安全发展示范城市名单,在相关政府网站上向社会进行为期10个工作日的公示,公开诉求渠道。

第十九条公示期结束后,国务院安委办及时将拟命名城市名单及有关情况报国务院安委会,审议通过后以国务院安委会名义为国家安全发展示范城市命名授牌,并向各省、自治区、直辖市及新疆生产建设兵团通报。

第六章 复 评

第二十条已获得命名的城市要以命名授牌为新起点,按照国家规定要求持续加强城市安全相关工作,在三年期限到期后的2个月内按照《评价细则》完成自评,围绕城市安全工作总结三年来的进展情况、查找存在的主要问题、提出下步工作计划,以城市人民政府名义报省级安委会。

第二十一条省级安委会要按照《评价细则》要求,组织对已获得命名城市复评情况开展复核,结合日常监督检查情况综合提出省级复核意见。复核意见要征求省级安委会相关成员单位意见,及时向社会公示、接受社会监督,于2个月内将有关情况报国务院安委办。

第二十二条国务院安委办要组织对通过省级复核的已获得命名城市进行综合评议,现场抽查核实参评城市主要评价指标是否满足《评价细则》要求,综合提出已获得命名城市是否保留命名的意见,征求国务院安委会相关成员单位意见并进行公示后,报国务院安委会审议通过,及时向社会公布。

第二十三条复评过程中,城市自评、省级复核以及综合评议的有关程序规定,参照本办法前述相关条款执行。

第七章 监督管理

第二十四条参评城市在正式命名授牌前存在下列情况之一的,取消本年度和下一年度的参评资格:

(一)参与评价的第三方人员在评价过程中未按规定开展相关工作,导致评价过程出现重大瑕疵、评价结果出现重大失真的;

(二)评价过程中隐瞒事实、弄虚作假的;

(三)其他影响评价工作客观公正的情形。

有前款第一项情形的,同时禁止相关第三方人员参加后续的国家安全发展示范城市评价工作。

第二十五条已获得命名城市存在下列情形之一的,由国务院安委会撤销命名并摘牌,以适当形式及时向社会公布:

(一)发生涉及城市安全重特大事故、事件的;

(二)未通过国务院安委办复评的;

(三)出现其他严重问题,不具备示范引领作用的。

第二十六条参与国家安全发展示范城市省级复核以及综合评议的人员要严格遵守中央八项规定精神要求,自觉执行廉洁自律、信息保密等工作规定。

第二十七条国务院安委会将把各地创建国家安全发展示范城市的情况作为省级人民政府安全生产考核的重要参考和依据,对工作成绩突出的地区给予表彰,在相关项目资金安排时予以适当倾斜。

地方各级人民政府应结合实际,对国家安全发展示范城市创建工作中贡献突出的单位和个人给予奖励,并在考核和评优方面优先考虑。

第八章 附则

第二十八条本办法所指事故、事件,应以城市行政区域范围内数据为准,按照《中华人民共和国突发事件应对法》《生产安全事故报告和调查处理条例》(国务院令第493号)《国家突发公共事件总体应急预案》等法律法规和规范性文件认定。

第二十九条国家安全发展示范城市牌匾,由国务院安委办设计样式并负责制作。

第三十条本办法由国务院安委办负责解释,自印发之日起实施。

Measures for evaluation and management of national security development demonstration cities
Chapter I General Provisions
Article 1 These measures are formulated in accordance with the requirements of the opinions of the CPC Central Committee and the State Council on promoting the reform and development in the field of work safety and the opinions of the general office of the CPC Central Committee and the State Council on promoting the safe development of cities in order to promote the establishment of a national model city for safe development and standardize the evaluation and management in the process of establishment.
Article 2 all regions shall actively participate in the establishment of national demonstration cities for safe development, adhere to the principles of cities' active application, level by level review and evaluation, joint participation of departments and naming dynamic management, establish a number of representatives of safe development cities with good basic conditions and strong guarantee ability throughout the country, give full play to the role of demonstration and guidance, and comprehensively improve the level of urban safety guarantee.
Article 3 the evaluation and management of national safety development demonstration cities shall be uniformly deployed by the work safety committee of the State Council (hereinafter referred to as the work safety committee of the State Council) and organized and implemented by the office of the work safety committee of the State Council (hereinafter referred to as the office of the work safety committee of the State Council).
Article 4 the national safety development demonstration city shall be evaluated and named once a year. After the city self-evaluation, provincial review and national evaluation, the safety committee of the State Council shall uniformly name and award the brand. The national security development demonstration cities that have been named will be re evaluated three years later. Those that meet the conditions will continue to retain their names. If they fail to pass the re evaluation, the safety committee of the State Council will revoke their names and delist them.
Article 5 the office of the safety committee of the State Council shall be responsible for formulating the detailed rules for the evaluation of national security development demonstration cities (hereinafter referred to as the detailed rules for the evaluation), and shall timely revise and improve them according to the actual situation.
Article 6 these measures are applicable to the evaluation and management of national security development demonstration cities named and licensed by the safety committee of the State Council.
Chapter II Basic Conditions
Article 7 the scope of the establishment of national security development demonstration cities includes sub provincial cities, prefecture level administrative regions and administrative regions (counties) under the jurisdiction of municipalities directly under the central government.
Article 8 cities participating in the establishment of national safety development demonstration cities (hereinafter referred to as participating cities) shall focus on the construction of urban safety development system based on production safety and actively promote the improvement of urban safety, mainly including the following five aspects:
(1) Source control. Integrate urban safety into the overall plan for economic and social development, strengthen the safety evaluation and demonstration of construction projects, promote the construction of urban infrastructure and safety facilities such as municipal safety facilities, urban underground comprehensive pipe corridors, road traffic safety facilities and urban flood control safety facilities, and promote the relocation, transformation and upgrading of enterprises in high-risk industries in urban areas.
(2) Risk prevention and control. Focus on preventing the risks of urban industrial enterprises such as hazardous chemical enterprises, oil and gas long-distance pipelines, tailings ponds, residue yards and construction operations, large-scale mass activities and "nine small" Places, high-rise buildings and other densely populated places, urban lifelines, public transportation, tunnels and bridges and other public facilities, floods, earthquakes, geology and other natural disasters.
(3) Supervision and management. We will improve the safety leadership responsibility of the city's party committees and governments at all levels for "the same responsibility of the party and government, one post and two responsibilities, joint management and accountability for dereliction of duty", and the relevant departments for "safety must be in charge of industry, business and production and operation" Actively carry out urban risk identification, assessment and monitoring, and constantly strengthen urban safety supervision and law enforcement.
(4) Support capacity. Strengthen the innovative application of safety science and technology, formulate the guidance directory for the government to purchase safety services, strengthen the punishment of dishonesty in the field of urban safety, establish a grid safety management system for urban communities, strengthen the release of public service advertisements and the construction of safety experience bases, and cultivate the urban safety culture atmosphere.
(5) Emergency rescue: establish an urban emergency management information platform, improve the emergency plan system and emergency information reporting system, unified command and multi department coordinated response mechanism, and emergency material reserve and transfer mechanism, increase the coverage of urban emergency shelters, strengthen the construction of national comprehensive fire prevention and rescue teams, improve the full-time, part-time and voluntary emergency rescue system, and establish an urban special emergency rescue system Industrialized emergency rescue bases and teams, and encourage enterprises and social forces to participate in rescue.
Article 9 under the following circumstances, they shall not participate in the establishment of national security development demonstration cities:
(1) Special major accidents and disasters occurred in the participating year and the first five natural years, or major accidents and disasters occurred in the participating year and the first three natural years;
(2) Being interviewed and notified by the safety committee of the State Council and the safety committee office due to poor work related to urban safety in the participating year and the previous natural year;
(3) The major potential safety hazards listed and supervised by the safety committee of the State Council and the safety committee office fail to be rectified in place on time;
(4) The city that has been named has been revoked by the safety committee of the State Council for less than 2 years;
(5) Major and extraordinarily serious environmental pollution and ecological damage events, drug safety events and food safety accidents have occurred in the year of participating in the evaluation and the previous natural year, or the losses of major and extraordinarily serious natural disaster events have expanded and caused adverse effects due to poor work;
(6) In other circumstances, it is not suitable to participate in the establishment of national security development demonstration cities.
In case of any of the above-mentioned situations in Items 1, 2, 3, 5 and 6 before the formal naming and licensing of the safety committee of the State Council, the naming and licensing of the participating cities shall be cancelled.
Chapter III City self-assessment
Article 10 participating cities shall establish and improve the organization and leadership mechanism for the establishment of national safe development demonstration cities, promote relevant departments to perform their respective duties and responsibilities, strengthen human, material and financial support measures, and coordinate and solve major problems in the establishment.
Article 11 participating cities shall, in accordance with the requirements of the evaluation rules, entrust experts, scholars, scientific research institutions, social organizations or intermediary organizations to carry out a third-party evaluation on the safety status of urban built-up areas. The third party personnel participating in the evaluation shall have professional knowledge that can cover urban safety related businesses, have no bad credit records such as violation of law and dishonesty, and be responsible for the relevant evaluation results according to law.
Article 12 If the evaluation results meet the requirements of the national safety development demonstration city standards, the participating cities may, in the name of the city people's government, submit an application to the Provincial Work Safety Committee (hereinafter referred to as the provincial safety committee) to participate in the establishment of the national safety development demonstration city, and submit the following materials:
(1) Urban construction;
(2) City self-assessment scoring;
(3) Rectification situation or rectification plan of urban safety related problems found in the process of self-assessment;
(4) Other materials to be submitted to the provincial safety committee.
Chapter IV provincial review
Article 13 the provincial safety committee office shall organize the preliminary examination of the materials submitted by the participating cities. If supplementary materials are needed, they shall be fed back to the participating cities in time; If it does not meet the requirements for participating in the evaluation, the evaluation of the current year shall be terminated.
Article 14 the provincial safety committee office shall organize personnel and experts of relevant member units to review the cities that have passed the preliminary review, specifically review and check the materials submitted by the participating cities, conduct on-site review of the items in the evaluation rules, and comprehensively put forward review opinions.
Article 15 the provincial safety committee office shall solicit the opinions and suggestions of the relevant member units of the provincial safety committee, comprehensively put forward the list of cities to be recommended to the Safety Committee Office of the State Council in combination with the daily supervision and inspection, make a social publicity for 10 working days on the relevant government websites and mainstream media at the provincial level, and disclose the appeal channels.
The provincial safety committee shall, in combination with the publicity acceptance, formally recommend the participating cities to the Safety Committee Office of the State Council before the end of July of the participating year, and submit the following materials:
(1) Relevant materials submitted by the people's governments of participating cities to the provincial safety committee to participate in the establishment of national security development demonstration cities;
(2) Provincial review;
(3) Provincial Publicity;
(4) Rectification or rectification plan of urban safety related problems found in the process of provincial review and publicity;
(5) Recommendation of Provincial Safety Committee;
(6) Other materials that need to be submitted to the office of the safety committee of the State Council.
Chapter V National Review
Article 16 the office of the safety committee of the State Council shall conduct a preliminary examination of the relevant materials of the participating cities recommended by the provincial safety committee. If they do not meet the requirements for participating in the evaluation, they shall be returned to the provincial safety committee and the qualification for participating in the evaluation in the current year shall be cancelled; If supplementary materials are needed, they shall be fed back to the provincial safety committee in time.
Article 17 the office of the safety committee of the State Council shall organize a comprehensive evaluation committee composed of personnel and experts from relevant member units of the safety committee of the State Council, which shall be specifically responsible for the comprehensive evaluation of the participating cities that have passed the preliminary examination.
The comprehensive evaluation committee mainly evaluates the procedures and materials of urban self-evaluation and provincial review, and organizes personnel to conduct spot checks in the participating cities to verify the completion of main evaluation indicators and put forward comprehensive evaluation opinions.
Article 18 the Safety Committee Office of the State Council shall solicit the opinions and suggestions of the relevant member units of the safety committee of the State Council, comprehensively put forward the list of national security development demonstration cities to be publicized in combination with the daily supervision and inspection, make a public announcement to the society for 10 working days on the relevant government websites, and disclose the appeal channels.
Article 19 after the publicity period is over, the office of the safety committee of the State Council shall timely report the list of cities to be named and relevant information to the safety committee of the State Council. After deliberation and approval, it shall name and license the national security development demonstration city in the name of the safety committee of the State Council, and notify all provinces, autonomous regions, municipalities directly under the central government and Xinjiang production and Construction Corps.
Chapter VI re evaluation
Article 20 cities that have been named shall take naming and awarding as a new starting point, continuously strengthen the work related to urban safety in accordance with the requirements of national regulations, complete the self-assessment in accordance with the evaluation rules within 2 months after the expiration of the three-year period, summarize the progress of urban safety work in the past three years, find out the main problems and put forward the next work plan, Report to the provincial safety committee in the name of the Municipal People's government.
Article 21 the provincial safety committee shall, in accordance with the requirements of the evaluation rules, organize the review of the re evaluation of the named cities, and comprehensively put forward the provincial review opinions in combination with the daily supervision and inspection. The review opinions shall solicit the opinions of relevant member units of the provincial safety committee, timely publicize them to the public and accept social supervision, and report the relevant information to the Safety Committee Office of the State Council within 2 months.
Article 22 the office of the safety committee of the State Council shall organize a comprehensive evaluation of the named cities that have passed the provincial review, spot check and verify whether the main evaluation indicators of the participating cities meet the requirements of the evaluation rules, comprehensively put forward opinions on whether the named cities should retain their names, solicit the opinions of relevant member units of the safety committee of the State Council and publicize them, It shall be submitted to the safety committee of the State Council for deliberation and approval, and shall be published to the public in a timely manner.
Article 23 in the process of re evaluation, the relevant procedures and provisions of urban self-evaluation, provincial review and comprehensive evaluation shall be implemented with reference to the above-mentioned relevant provisions of these measures.
Chapter VII Supervision and Administration

Article 24 in case of any of the following circumstances before the formal naming and licensing of the participating cities, the qualification for the current year and the next year shall be cancelled:
(1) The third party personnel involved in the evaluation fail to carry out relevant work in accordance with the provisions in the evaluation process, resulting in major defects in the evaluation process and major distortion of the evaluation results;
(2) Concealing facts and practicing fraud in the process of evaluation;
(3) Other circumstances that affect the objectivity and impartiality of the evaluation.
In case of any of the circumstances in Item 1 of the preceding paragraph, relevant third-party personnel shall be prohibited from participating in the follow-up evaluation of national security development demonstration cities.
Article 25 in case of any of the following circumstances in a named city, the safety committee of the State Council shall revoke the name and delist, and timely announce it to the public in an appropriate form:
(1) Major accidents and events involving urban safety;
(2) Failing to pass the re evaluation by the office of the safety committee of the State Council;
(3) There are other serious problems and do not have the role of demonstration and guidance.
Article 26 personnel participating in the provincial review and comprehensive evaluation of national security development demonstration cities shall strictly abide by the spiritual requirements of the eight provisions of the central government, and consciously implement the working regulations on integrity, self-discipline and information confidentiality.
Article 27 the safety committee of the State Council will take the establishment of national safety development demonstration cities in various regions as an important reference and basis for the work safety assessment of the provincial people's governments, commend the regions with outstanding work achievements, and give appropriate preference in the fund arrangement of relevant projects.
Local people's governments at all levels shall, in combination with their actual conditions, reward units and individuals that have made outstanding contributions to the establishment of national model cities for safe development, and give priority to assessment and evaluation.
Chapter VIII supplementary provisions
Article 28 the accidents and incidents referred to in these Measures shall be subject to the data within the administrative region of the city, and shall be identified in accordance with the emergency response law of the people's Republic of China, the regulations on the reporting, investigation and handling of production safety accidents (Order No. 493 of the state Council), the national overall emergency plan for public emergencies and other laws, regulations and normative documents.
Article 29 the plaques of national security development demonstration cities shall be designed and made by the office of the safety committee of the State Council.
Article 30 these Measures shall be interpreted by the office of the safety committee of the State Council and shall be implemented as of the date of printing and distributing.
